New Jersey Assembly Introduces Landmark Forfeiture Amendments Bill -- F.E.A.R. Chronicles, Vol 1. No. 4, (September, 1992) New Jersey Assemblymen Penn, Garrett and Kavanaugh proposed amendments to New Jersey Assembly Bill No. 1536 which would require an owner to be criminally convicted before his property could be forfeited. The amendments would prohibit forfeiture of property seized as a result of an illegal search and seizure. They also include a proportionality requirement: Property seized under this chapter, which is not prima facie contraband, shall not be subject to forfeiture to the extent that the forfeiture would be disproportionate to both the gain from the conduct giving rise to forfeiture and the nature and severity of the conduct. The bill is being considered by the Assembly Judiciary Law and Public Safety Committee. We owe John Paff all the credit in the world for this amazing feat!
