MOTION TO SUPPRESS EVIDENCE AND STATEMENTS

The respondent, through undersigned counsel, respectfully moves this Court, pursuant to One 1958 Plymouth

Sedan v. Commonwealth of Pennsylvania, 380 U.S. 693 (1965) and the Fourth Amendment to the United States

Constitution, to suppress as evidence against him all statements made by him and all items of property seized

during the stop and search of his automobile

Under Franks, if a defendant makes a substantial preliminary showing that a false statement knowingly and

intentionally, or with reckless disregard for the truth, was included by a police officer in his application for a

search warrant, and also establishes that the allegedly false statement was necessary to the court's finding of

probable cause, the defendant is entitled to a hearing on the validity of the warrant. Franks, 438 U.S. at 155-56;
